Conditions of Sale
  1. All prospective buyers must be at least 21 years old and are required to register with SAH prior to the bidding, by using a bid number. The bidder acknowledges he has received, read, and understands and agrees to be bound by the terms and conditions of the auction either on the buyer’s agreement or posted at the auction facility or online. Moreover, the bidder must have the capacity to enter into a contract (or, in other words, the bidder must be free from the influence of alcohol or other intoxicating substances, be free from mental illness and financially capable of paying for whatever bids s/he makes).

  2. The auction will be conducted by offering the items by lot, either individually or in groups. The bidder offering the highest bid accepted by SAH shall be the purchaser of the offered lot, and no purchaser shall retract their bid. Purchaser accepts a lot when a bid is made. All sales are final.

  3. The bidder, whether acting as principal, agent, officer or director of a company or otherwise, in any capacity whatsoever and the company he/she represents, both jointly and severally agrees to indemnify and hold harmless SAH and its officers, directors, employees, agents, attorneys and its consignors, from any and all actions, causes of actions, suits, claims for damages and costs, and losses of any nature, including injury and death, arising from the purchase or use of any items, or the attendance or participation of bidder, his/her agents or employees, at the auction and/or on the auction site whether before, during, or after the auction.

  4. Bidder agrees to be directly responsible for the payment of the purchase price, Auctioneer's fees, (and in the case of automobile purchases bidder will be directly responsible to the appropriate agency for all applicable DMV fees, and taxes due on all of bidder's purchases). In addition, vehicle purchases may be subject to compliance with the California Air Resources Board (CARB) regulations. The sole responsibility for this compliance rests with the Buyer. Buyer also agrees to hold SAH harmless for failure to pay any fees or taxes or in any other way for failing to comply with state law with regards to the purchase of a motor vehicle.

  5. A Buyers Premium of 20% for all purchases by credit card and 18% for all purchases by cash/check/wire transfer will be added to the bid price of each item purchased unless otherwise noted. Specific auction items may be exempt from the buyer’s premium. Internet bidders are subject to an additional 3-5% administration fee for online sale, depending on the company used by internet bidders.

  6. The purchaser must pay the entire purchase price of any auction lot within seven days of the date of the auction, which will not be refunded.

  7. Interest on overdue amounts will be paid by purchaser at a rate of 2% per month, 24% annual rate, or at such other maximum rate allowed by law.

  8. State and local sales tax will be assessed and collected on all purchases unless legal exemption documentation is provided at the time of sale.

  9. SAH may elect to record either through video or audio the auction. You hereby waive all objections to this activity and release SAH from any and all liability due to said recording. In the case of a conflict over price or a disagreement between the two bidding books maintained by the Auctioneer and his/her assistant/clerk, SAH will review the audio and/or video recordings to determine the correct price and will adjust the final purchase price accordingly.

  10. The Auction Terms and Conditions shall be governed by and interpreted under the laws of the State of California, and any action hereunder against SAH shall be resolved through binding arbitration conducted through Judicial Arbitration and Mediation Service (JAMS), Alternate Dispute Resolution Service (ARC), or through any mutually agreed upon arbitrator selected by the parties in the County of Los Angeles, State of California.

  11. All items are sold "AS IS-WHERE IS" without any guarantees or warranty expressed or implied, statutory or otherwise of any nature whatsoever in respect of the lots offered at the auction. Specifically, but without limitation, SAH makes no representation or warranty that any of the lots conform to any standard in respect to safety, pollution or hazardous material, or fit for any particular purpose. SAH, or any member of its staff, makes no guarantee as to the material authenticity, of any particular age, year of manufacture, model, origins, dimensions, availability, color, description, hours, condition, or defect of any lot or item being sold. Bidders are encouraged to make their own physical inspection and rely solely on that inspection before bidding. Failure to inspect does not negate the bidder’s responsibility to perform under the auction terms and conditions.

  12. The Auction Catalog has been prepared as a guide, and should be used only as a guide. Although the descriptions are believed to be correct, their accuracy cannot be guaranteed or warranted. The Bidder acknowledges that all auction items are available for inspection prior to the auction and it is the Bidder’s responsibility to have inspected the items(s) before bidding. No sale shall be invalidated, nor shall auctioneers be liable as a result of defects or inaccuracies of any lot.

  13. Bidder acknowledges that an auction site is a potentially dangerous place, i.e. flammable, noxious, corrosive and pressurized substances are present, heavy equipment is being operated and electric circuits may be live. Every person at the auction site, at any time, shall be there at his/her own risk without notice of the condition of the premises and the activities thereon and the bidder shall so advise his/her agents and employees. No person shall have any claim against SAH, its officers, directors, agents, employees, principals, or attorneys for any injuries sustained or loss of property which may occur from any cause whatsoever.

  14. Any dispute arising as to any bidding shall be resolved by SAH at their sole discretion, and SAH may put the lot in dispute up for sale again. SAH reserves the right to refuse any bid, which it considers to be an insignificant advance over the preceding bid. No person shall bid on any lot of which he is the Consignor, agent, associate, or on behalf of the Consignor.

  15. Bid rigging (or a conspiracy to fix a bid) is illegal. Any person that attempts to rig or fix bids will be prosecuted.

  16. Purchaser is responsible for insuring their purchases immediately after payment. SAH shall not be responsible for loss, damage, or theft of any purchase. Purchaser shall not be entitled to remove any item from the auction facility until all of their purchases are paid for in full including all applicable goods, sales or use taxes.

  17. If any check offered by Buyer to SAH in payment of auction lot or any other amount due under this Agreement is returned for lack of sufficient funds, a “stop payment” or any other reason, Buyer will pay SAH a returned check charge of $25.00.

  18. Removal of all items shall be the sole responsibility of the purchaser, yet SAH will hold item and not allow removal until payment for the item clears. Loading assistance is provided as a courtesy; however, purchaser assumes all risk and responsibility for loading and removal of purchases. SAH reserves the right to require proof of adequate insurance coverage from any purchaser items requiring dismantling, rigging or hot cutting. Purchaser agrees to indemnify and hold harmless both SAH and any consignor, their shareholders, officers, directors, agents, employees and attorneys against any damage caused by the acts of purchaser. All items must be removed from the auction facility within fourteen (14) days after the auction date. If for any reason, purchaser fails to remove any purchase within the time specified, the purchase shall be deemed abandoned and SAH at their sole discretion may resell the items. Purchaser shall be liable for any rent incurred or damages suffered by SAH because of purchaser's failure to remove any item. Failure to remove items will result in a rental/storage fee of not less than $25 per item per day.

  19. California law does not provide for a "cooling off" or other cancellation period for vehicles. Therefore, you cannot later cancel a contract simply because you change your mind, decide the vehicle costs too much, or wish you had acquired another vehicle.

  20. Funds for a vehicle purchase must be certifiable prior to the processing or release of DMV documents. Documents will be prepared to be effective only in the jurisdiction in which the auction is being conducted.

  21. If SAH is unable to make available or deliver the purchase or clear title to the same, or documentation required in respect of any purchase, such as “Bill of Sale” or a “Seller’s Invoice”, whether before or after delivery, SAH's sole liability shall be the return of monies paid in respect of such purchase upon its return by purchaser. Any such purchase shall be returned or surrendered upon demand by SAH.
